1. Acceptance & Service Description

Folio is a paid macOS application designed to help you browse, manage, and back up your personal content on SmugMug. By using this application, you agree to these terms.

2. Payments & Merchant of Record

All payments for Folio are processed by Lemon Squeezy, which acts as the Merchant of Record for all transactions. This means that when you purchase Folio, you are transacting with Lemon Squeezy, not directly with CustomSmug. Lemon Squeezy handles payment processing, sales tax collection and remittance, invoicing, and PCI DSS compliance on our behalf.

By purchasing Folio, you also agree to Lemon Squeezy's Buyer Terms & Conditions and Privacy Policy.

3. Free Trial

Folio offers a 7-day free trial. No payment information is required to start the trial. After the trial period expires, you must purchase a license to continue using the application. The trial provides full access to all features.

4. License

A Folio license is a one-time purchase that grants you the right to use the application on your personal devices. The license is managed through Lemon Squeezy's licensing system. License keys are validated at activation and periodically thereafter. The license is non-transferable unless otherwise stated.

5. Refunds

Refunds are handled by Lemon Squeezy and are provided at their sole discretion on a case-by-case basis. If you experience issues with Folio, please contact us first so we can try to resolve the problem. If a refund is necessary, we will process it through Lemon Squeezy. Please contact us or Lemon Squeezy support before initiating a chargeback with your bank.

6. Independence Disclaimer

This application is NOT affiliated with, endorsed by, sponsored by, or associated with SmugMug, Inc. in any way. It is an independent, personal project created to help photographers manage their own content.

7. User Responsibilities

By using this application, you assume full responsibility for:

• Backing up your data before use
• Ensuring adequate storage space on your device
• Keeping your API credentials secure
• Using the app only with accounts you own or have permission to access

8. Warranty Disclaimer

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

9. Limitation of Liability

The developer shall not be liable for any lost files, failed downloads, hardware damage, lost productivity, or any other damages arising from the use of this application. Maximum liability is limited to the purchase price paid for the application.

10. Indemnification

You agree to defend and hold harmless the developer against any claims arising from your misuse of the application or violation of these terms.

11. Third-Party Dependencies

This application relies on SmugMug's API, which may change at any time without notice. The developer has no control over SmugMug's services and cannot guarantee continued functionality.

12. Modifications & Termination

These terms may be modified at any time. The application may be discontinued at any time without notice. Continued use after changes constitutes acceptance of new terms.

Our Core Principle

What IS Stored Locally (On Your Mac Only)

• Your SmugMug API credentials and OAuth tokens (stored in macOS Keychain)
• App preferences and settings
• Download history (for resume functionality)
• Local troubleshooting logs

All of this data stays on your device and is never transmitted to us or any third party.

AI Auto-Tagging

Folio's AI auto-tagging feature uses Apple's Vision framework and runs entirely on your Mac. No images are uploaded to any external service for analysis. All processing happens locally on your device.

Network Connections

The application only connects to:

• api.smugmug.com — SmugMug's official API
• secure.smugmug.com — SmugMug's secure endpoints
• api.lemonsqueezy.com — License validation and activation

All connections use HTTPS. There are no connections to third-party analytics, advertising networks, or social media platforms.

Payments & Licensing (Lemon Squeezy)

Folio uses Lemon Squeezy as our Merchant of Record for payment processing and license management. When you purchase a license or activate a trial, Lemon Squeezy may collect:

• Name and email address
• Billing address
• Payment information (credit/debit card details)
• IP address, browser type, and device information
• Transaction and invoice data

This data is collected and processed by Lemon Squeezy directly — we do not store your payment information. Lemon Squeezy is PCI DSS compliant and handles all payment data securely. For details on how Lemon Squeezy handles your data, see their Privacy Policy.

License Validation

Folio periodically connects to Lemon Squeezy's API to validate your license key. This transmits only your license key and basic device information needed for activation. No personal files, photos, or SmugMug data are shared during this process.

Data Security

Your API credentials and OAuth tokens are stored in the macOS Keychain, Apple's secure credential storage system. This ensures your credentials remain secure and are never stored in plain text files.

Your Rights & Data Deletion

You have complete control over your data. To delete all stored information, simply remove the application from your Mac. There is no data stored elsewhere to delete.

Children's Privacy

This application is not directed at users under 13 years of age.
